The 20th amendment to the U.S. Constitution says the terms of the president and vice president end at noon Jan. 20. If an election had not taken place by that date and successors had not been chosen, Trump and Vice President Mike Pence would be out of office, regardless.

Raskin, a former constitutional law professor and member of the House Judiciary Committee, said the panel would include doctors as well as former presidents and Cabinet secretaries, who would each serve four-year terms.

Ratified in 1967 after the assassination of President John F. Kennedy, the 25th Amendment outlines procedures for a transfer of presidential power to the vice president in the cases of death, incapacitation, removal or resignation.

If there is reason for optimism, it might be that the PRC has yet to officially suspend political communication channels at the executive and diplomatic levels, so a conflict could be deescalated through high-level interventions, as happened during the EP-3 spy plane incident in 2001. Biden and Xi could also agree to appoint presidential envoys tasked with the specific mission to ratchet down tensions in the Taiwan Strait.

In emergency situations, Congress could pass a concurrent resolution requiring the Commission to examine the President, determine his/her ability to execute the powers and duties of the office, and report its findings to Congress. Although Section 4 of the 25th Amendment has not been invoked yet, other provisions of the Amendment have been. For example, when Presidents Ronald Reagan and George W. Bush underwent medical procedures, they notified Congress and temporarily delegated presidential authority to their Vice Presidents.

House Speaker Nancy Pelosi has her fans and her detractors, but now some social media posts are trying to use the California congresswoman to steer voters away from supporting Democratic presidential nominee Joe Biden and his running mate, Sen. Kamala Harris.

Under the amendment, which was ratified after the assasination of President John F. Kennedy, whenever there is a vacancy in the office of the vice president, the president must nominate a vice president. That person must then be confirmed by a majority vote in both the House and Senate.

When Nixon himself resigned in August 1974, Ford became president and nominated former New York Gov. Nelson A. Rockefeller to be vice president. Rockefeller was confirmed and took the oath of office toward the end of that year.

If Biden were elected president and then stepped down, Harris would assume the office, and she could nominate Pelosi to become vice president, or someone else. Whoever she nominates would have to be confirmed by both houses of Congress..

Speaking on the House floor, Pelosi took a victory lap over legislative achievements she'd had under former Presidents George W. Bush, Barack Obama, and Joe Biden, holding up three fingers and saying she "enjoyed working under three presidents."

When Trump was president, Pelosi oversaw both of his impeachments and successfully messaged the GOP's attacks on the Affordable Care Act to win a majority in the US House in 2018. The two leaders frequently and openly clashed during Trump's presidency.

President Joe Biden does not have the authority to unilaterally cancel federal student loan debt, House Speaker Nancy Pelosi said Wednesday, weighing in on the contentious debate and push by Senate leaders and progressives for the president to eliminate the roughly $1.5 trillion that borrowers owe.

"People think that the president of the United States has the power for debt forgiveness," she said during a press conference on Wednesday. "He does not. He can postpone, he can delay, but he does not have that power. That has to be an act of Congress."

Her remarks come as Senate Majority Leader Chuck Schumer of New York, Senate Whip Dick Durbin of Illinois, Democratic Sen. Elizabeth Warren of Massachusetts and a growing number of progressive members in the House call on the president to use his executive power to cancel up to $50,000 in student loan debt for 40 million borrowers.

They argue that Biden has the authority to do so under section 432(a) of the Higher Education Act, which allows the Education Secretary Miguel Cardona the authority to "compromise, waive, or release any right, title, claim, lien, or demand, however acquired, including any equity or any right of redemption." They also argue that the president owes it to Black voters, whose support propelled Biden into the White House and who are disproportionately burdened by student loan debt.
